Welcome to the T-Mobile Support Community (“Community”). You agree that by accessing the Community you are bound to these Terms of Use and the Usage Guidelines found at http://support.t-mobile.com as well as T-Mobile’s privacy policy found at www.t-mobile.com/privacy-center (collectively, the “Agreement”). T-Mobile reserves the right to change the terms and conditions of this Agreement at any time.
Community Use
The Community contains a communication forum designed to enable you to communicate about the resolution of issues regarding T-Mobile products and services. You agree to use the Community only to post, send and receive messages and material that are appropriate and related to the purpose of the Community. You agree that, when using the Community, you will not use or attempt to use the Community for any fraudulent, unlawful, harassing or abusive purpose, or so as to damage or cause risk to our business, reputation, employees, subscribers, facilities, or to any person.
Improper uses include, but are not limited to: (a) Violating any applicable law or regulation; (b) Posting or transmitting content you do not have the right to post or transmit; (c) Posting or transmitting content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other right; (d) Posting or transmitting content that is unlawful, untrue, stalking, harassing, libelous, defamatory, abusive, tortious, threatening, obscene, hateful, harmful or otherwise objectionable, as determined in our sole discretion; (e) Attempting to intercept, collect or store data about third parties without their knowledge or consent; (f) Deleting, tampering with or revising any material posted by any other person or entity; (g) Accessing, tampering with or using non-public areas of the Community, T-Mobile's computer systems and network or any T-Mobile website; (h) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (i) Attempting to access or search the Community, the T-Mobile network or any T-Mobile website with any engine, software, tool, agent, device or mechanism, other than the software and/or search agents provided by us or other generally available third party web browser; (j) Sending or attempting to send unsolicited messages, including without limitation, promotions or advertisements for products or services, "spam", "chain mail" or "junk mail"; (k) Using or attempting to use the Community, the T-Mobile network or any T-Mobile website to send altered, deceptive or false source-identifying information; (l) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising, or in any way making up, a part of the Community, the T-Mobile network or any T-Mobile website; (m) Interfering or attempting to interfere with the access of any user, host or network, including without limitation, sending a "virus" to the Community, the T-Mobile network or any T-Mobile website, overloading, "flooding," "spamming," "crashing," or "mailbombing" the Community, the T-Mobile network or any T-Mobile website; (n) Impersonating or misrepresenting your affiliation with any person or entity; (o) Using the Community to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes", "Ponzi schemes", unregistered sales of securities, and securities fraud; or (p) Excessively high volume data transfers or bandwidth consumption, hosting of a web server, internet relay chat server or any other server, and non-traditional end user activities.
If we suspect violations of any of the above, we may discontinue your access to the Community, the T-Mobile network or any T-Mobile website, institute legal action and/or cooperate with law enforcement authorities in bringing legal proceedings against violators. You agree to reasonably cooperate with us in investigating suspected violations.
T-Mobile reserves the right to install, implement, manage and/or operate one or more software applications, monitoring programs, or other solutions designed to assist us in identifying and/or tracking activities that we consider to be illegal or violations of this Agreement, including, but not limited to, any of the activities described in this “Community Use” Section. We may, but are not obligated to, in our sole discretion, and without notice, remove, block, filter or restrict by any means any materials or information (including, but not limited to, emails) that we consider to be actual or potential violations of the restrictions set forth in this Agreement, including, but not limited to, those activities described in this “Community Use” Section and any other activities that may subject T-Mobile or its customers to harm or liability. T-Mobile disclaims any and all liability for any failure on its part to prevent such materials or information from being transmitted through the Community.
Content
T-Mobile does not claim ownership of the materials you provide to T-Mobile (including feedback and suggestions) or post, upload, input or submit to the Community (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting T-Mobile, its affiliated companies, and necessary sublicensees, permission to use your Submission in connection with the operation of the Community and their businesses, including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission. No compensation will be paid with respect to the use of your Submission, as provided herein. T-Mobile is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in T-Mobile's sole discretion.
By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission, as described in this “Content” Section, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions. You further agree that Submissions shall not be considered confidential.
Content Disclaimer: Cautions and Restrictions
T-Mobile does not control, nor are we responsible or liable for, data, content, information services, or products (including software) that you access, download, or receive via the Community. We may, but do not have to, block Submissions or other information, transmissions or access to certain information, services, products or domains to protect us, our network, the public or our users. T-Mobile reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in T-Mobile's sole discretion.
T-Mobile does not control or endorse the content, messages or information found in any Submissions and, therefore, T-Mobile specifically disclaims any liability with regard to the Submissions and any actions resulting from your participation in the Community. Managers and hosts are not authorized T-Mobile spokespersons, and their views do not necessarily reflect those of T-Mobile. We are not a publisher of third party content accessed through the Community and are not responsible for the content, accuracy, timeliness or delivery of any Submissions, opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Community.
T-Mobile Employee
T-Mobile employees may participate in the T-Mobile Support Community, but are required to be identified by a T-Mobile logo or badge. All T-Mobile employees are bound by the T-Mobile Employee Handbook and T-Mobile Code of Business Conduct, as well as T-Mobile’s Privacy policies and Security policies when accessing, using, or participating in the Community. Except Community Specialists described below, T-Mobile employees may not ask Community members for any personal information via a post in a community forum or via Private Message (PM). T-Mobile employees are not authorized to access customer accounts in any capacity or for any reason. T-Mobile employees that participate in the Community do not represent T-Mobile, may not claim to speak on behalf of T-Mobile, and their views and opinions do not necessarily reflect those of T-Mobile. A T-Mobile employee’s failure to comply with this Agreement, these Terms of Use, and/or the T-Mobile Support Community Usage Guidelines will result in corrective action up to and including termination.
Certain T-Mobile Social Customer Support Specialists may be identified with a specific T-Mobile badge, such as moderator (“MOD”), T-Force (“T-Force”) or administrator (“ADMIN”) (collectively, “Community Specialists”). Such specifically identified Community Specialists may, in limited circumstances within their working capacity and hours, assist a customer with an account related inquiry or service issue via a separate Private Message (PM) outside the Community. No other T-Mobile employees participating in the Community may provide such account related assistance.
Digital Millennium Copyright Act (“DMCA”) Notice
If you believe that material available in the Community or residing on our system or network infringes a copyright of yours or a third party, please notify our Designated Agent by using the procedures described in the Digital Millennium Copyright Act (“DMCA”) and below. After receiving notice, we may remove or disable access to any infringing material as provided for in the DMCA. Our Designated Agent under the DMCA is Copyright Agent, 12920 SE 38th Street, Bellevue, WA 98006, 425-378-4000, copyrightagent@t-mobile.com. There are substantial penalties for sending false notices. It is T-Mobile’s policy, in appropriate circumstances and in its sole judgment, to suspend or terminate access to the Community by any user who is deemed to be a repeat or blatant infringer of copyrights.
Governing Law, Jurisdiction and Venue
These Terms of Use are governed by, and construed and enforced in accordance with, the laws of the State of Washington, as they are applied to agreements entered into and to be performed in Washington. Any action you, any third party, or T-Mobile may bring to enforce these Terms of Use in connection with any matters related to this Community will be brought only in the State and Federal courts located in King County, Washington, and you expressly consent to the jurisdiction and venue of such courts.
